Mobile World Live reported that the proposed framework was considered through the Energy and Climate Change Ministerial Council process and covered power use, water demand, siting, renewable energy support, and efficiency. Unanimous state support is required for the legislation to proceed.

The disagreement reflects a wider infrastructure tension. Governments want AI capacity, cloud growth, sovereign capability, and investment, while electricity networks, water systems, and local planning authorities have to manage the physical burden.

Rules collide with development competition

National data centre regulation can look straightforward from a system-planning perspective. Large facilities could be required to support new power supply, reduce water exposure, choose suitable sites, invest in renewables, and meet efficiency requirements. Those conditions would make the infrastructure cost more visible and reduce the risk that grids or water systems absorb demand without corresponding investment.

State governments may read the same rules differently. Strict national controls can be seen as a brake on inward investment, especially where regions are trying to attract AI infrastructure, data centre campuses, and associated energy development. The more competitive the market becomes, the harder it is to secure common standards.

Australia’s geography adds another layer. A remote data centre with access to renewable generation, land, and industrial-scale infrastructure has a different operating profile from a facility near a constrained urban water system. Uniform regulation can improve certainty, but it can also miss local differences in energy mix, water availability, grid strength, climate, and community tolerance.

The water question is particularly sensitive. High-density AI facilities can drive heavier cooling requirements, and public scrutiny grows quickly where projects are associated with drinking water pressure, drought exposure, or abandoned recycling plans. Operators will increasingly need to show how cooling choices translate into measurable water outcomes.

Europe is writing similar rules

European data centre regulation is moving towards more detailed reporting and performance scrutiny. The EU energy efficiency framework brings larger facilities into data reporting, while national governments are examining planning, grid access, water use, heat reuse, and resilience. The UK’s critical infrastructure treatment adds another layer around continuity and security.

The Australian dispute shows how fast data centre policy can become a negotiation between national strategy and regional competition. A central government may want a consistent framework. Local authorities may want investment. Utilities may want clearer cost allocation. Communities may want limits on land, water, and power use.

A workable framework will need to separate measurable infrastructure outcomes from generic sustainability claims. Power procurement, grid reinforcement, water consumption, heat recovery, emissions, resilience, and local infrastructure costs can be tested. Broad claims about AI growth or green data centres cannot carry the policy burden.

Europe’s challenge is to avoid writing rules too late, after grid queues are already blocked and public opposition has hardened. Clear standards can give developers a firmer route to consent if they are practical, evidence-based, and applied consistently enough to reduce regulatory arbitrage.

Australia’s stalled process does not end the regulatory debate. It shows where the argument now sits: between the desire to host AI infrastructure and the need to control the power, water, and land demands that come with it.
