The direction effectively overturns the screening position previously taken by City of Edinburgh Council, which had concluded that the project did not require an EIA. The reporter found that likely significant environmental effects could not be ruled out on the information available.
Developer Shelborn must confirm by 20 August whether it intends to prepare the assessment. If it does not respond, Scotland’s Planning and Environmental Appeals Division will no longer be required to determine the appeal.
The appeal follows the council’s rejection of the proposed data centre in February. Councillors concluded that the application had not sufficiently demonstrated how the project would address greenhouse-gas emissions, climate policy, and its relationship with wider regeneration plans.
Power claims require a fuller test
The reporter’s screening direction centres on the scale of the proposed electricity demand. At an estimated 210MW during operation, the facility would introduce a large and continuous load in addition to the energy and emissions associated with construction.
The developer has said the data centre would use renewable electricity and has referred to a possible power purchase agreement. The reporter found that the available material did not establish how the full demand would be met or whether the procurement approach would require additional renewable generation.
A contractual claim to renewable power does not, on its own, describe the physical supply available during every operating hour. A full assessment will need to distinguish between accounting arrangements, grid electricity, additional generation, and any consequences for the wider energy system.
Backup power is another unresolved element. Project documents have referred to diesel generators and the possible use of hydrotreated vegetable oil, but details including generator numbers have not been supplied. Both emergency operation and routine testing could produce emissions and local air-quality effects.
The reporter also identified gaps around waste heat. The application has referred to the possibility of connecting the data centre to a future heat network, but no sufficiently developed scheme has shown the available temperatures, likely customers, connecting infrastructure, or proportion of heat that could be used.
A planning test with wider consequences
The EIA will not determine whether the data centre is approved. It will provide a fuller evidence base covering the project’s likely environmental effects, potential mitigation, and reasonable alternatives before the appeal is decided.
That distinction is important. Large data centres are not automatically unacceptable because they consume substantial electricity, but the scale and continuity of their demand make energy sourcing, backup systems, cooling, emissions, and heat rejection material planning questions.
The direction could influence how other Scottish authorities screen hyperscale proposals. Campaign groups say seven of the 12 large data centre projects that have reached the screening stage were not required to prepare full assessments, leaving a varied approach to projects with similar infrastructure demands.
A full EIA would bring the South Gyle proposal closer to the level of scrutiny commonly applied to other energy-intensive industrial development. It would also require the developer to assemble its power, emissions, backup generation, construction, and heat-recovery assumptions into one assessable package.
The immediate decision rests with Shelborn. Confirming an EIA would keep the appeal alive but extend the programme and expose the project’s technical assumptions to further public and regulatory examination.
Declining to prepare one would leave the appeal without the information the reporter now considers necessary. Either way, the development can no longer progress on the basis that its environmental effects are too limited or too certain to require a full assessment.
